Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Freewheel mobile application and related features (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of entering into a binding agreement under applicable law to use the Service. If you use the Service on behalf of another person or organization, you represent that you have authority to bind them to these Terms.
2. Ride Tracking Only
Freewheel is a ride-tracking and ride-review tool. It is not a navigation system, emergency-response tool, safety guarantee, or substitute for your own judgment while cycling.
You are responsible for riding safely, obeying traffic laws, and deciding when it is appropriate to use the Service before, during, or after a ride.
3. License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, in accordance with these Terms and the rules of the app store from which you downloaded the App.
4. Your Ride Data and Content
The Service may let you record rides and generate ride summaries or shareable outputs.
- You retain ownership of the ride data and content you create.
- You are responsible for the legality and appropriateness of anything you choose to export or share.
- You must not use the Service in a way that violates applicable law or another person's rights, including privacy or intellectual property rights.
Freewheel is designed to keep ride data on your device. Current versions of the Service do not provide an account, cloud backup, or server-side restore. If you choose to export or share ride-related content, you are responsible for what you disclose and where you send it, and for keeping your own copies of any rides you want to preserve outside the device.
5. Permissions and Device Limits
Some features depend on device permissions and platform behavior.
- Ride recording depends on location access.
- Background ride recording depends on the operating system continuing to allow location access while the screen is locked or the app is not in use.
- Elevation estimates may vary depending on hardware sensors, signal quality, and operating-system behavior.
If you deny or revoke required permissions, parts of the Service may stop working or may work only in a limited way.
6. Acceptable Use
You agree not to:
- use the Service in violation of any applicable law or regulation
- interfere with, disrupt, or compromise the Service or related systems
- attempt to gain unauthorized access to the Service or our systems
- reverse engineer, decompile, or disassemble the Service except where applicable law expressly permits it
- use the Service to create or distribute unlawful, abusive, hateful, infringing, or otherwise prohibited content
7. Third-Party Services and Platforms
The Service may rely on mobile operating-system services or share destinations you choose to open. We do not control those third-party services, and your use of them may be governed by their separate terms and privacy policies.
8. Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service, or any feature of it, will always be available, uninterrupted, secure, or error-free.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
Ride metrics, route reconstructions, elevation estimates, and background recording behavior may vary based on device hardware, permissions, operating-system behavior, environmental conditions, and sensor availability.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, business, or goodwill arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid, if any, for the Service during the 12 months before the event giving rise to the claim.
11. Termination
We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use creates risk, harm, or legal exposure. You may stop using the Service at any time by uninstalling it.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and publish the revised version through the Service, the relevant app store listing, or another appropriate channel. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
