Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Affirm mobile application, related widgets, reminders, optional account and cloud backup features, and optional Pro subscription features (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to use the Service. If you use the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

2. Wellness Use Only

Affirm is intended for personal wellness, reflection, and motivation. It is not medical advice, mental health treatment, crisis support, or emergency-response service.

Do not rely on the Service as a substitute for professional medical, psychiatric, psychological, or therapeutic care. If you believe you are experiencing an emergency or may harm yourself or others, contact local emergency services or a qualified professional immediately.

3. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, in accordance with these Terms and the rules of the app store from which you downloaded the App.

4. Accounts

You can use the core Service without an account. Some features, including cloud backup and sync, require you to create an account by signing in with Sign in with Apple or Google Sign-In.

• You are responsible for maintaining the security of the Apple or Google account you use to sign in, and for activity that occurs under your Affirm account.
• You agree to provide accurate information and to keep it up to date.
• You must be old enough to consent to these Terms and to create an account under applicable law.
• We may suspend or terminate an account that violates these Terms or that we reasonably believe creates risk, harm, or legal exposure.

You may sign out or request deletion of your account at any time. Deleting your account removes account information and backed-up content associated with it, as described in our Privacy Policy, except where we are required or permitted to retain certain records by law.

5. Your Content

The Service may allow you to create custom affirmations and attach optional voice notes or images.

• You retain ownership of the content you create.
• You are responsible for the legality, accuracy, and appropriateness of any text, image, audio, or other content you add to the Service.
• You represent that you have the rights needed to use any content you add to the Service.
• You must not use the Service to store, create, or share content that is unlawful, infringing, abusive, threatening, hateful, sexually explicit, or otherwise violates applicable law or third-party rights.

If you enable cloud backup, you grant us a limited license to host, store, transmit, back up, and restore your content solely to provide the backup and sync features to you and across your devices. This license exists only to operate those features and ends when you delete the content or your account, subject to routine backups and legal retention.

6. Cloud Backup and Sync

Cloud backup and sync are optional features that store your content on our servers so it can be restored and kept in sync across your devices.

• We aim to keep your backed-up content available, but we do not guarantee that it will always be available, uninterrupted, or free from loss, and you are responsible for keeping your own copies of important content.
• Backup and sync depend on network connectivity and on third-party hosting and storage providers.
• We may set reasonable limits on storage, file sizes, or usage to protect the Service.

7. AI-Generated Affirmations

The Service may offer an optional feature that uses AI to generate affirmation suggestions from a goal or description you provide.

• Suggestions are generated by a third-party AI provider from the input you submit, and are added to your library only if you choose to save them.
• AI output may be inaccurate, generic, or not suited to your situation. It is not medical, psychological, or professional advice (see "Wellness Use Only" above), and you are responsible for deciding whether to rely on or keep any suggestion.
• Do not submit sensitive personal information, or content that is unlawful or infringes others' rights, when using the generator.
• Generation is subject to usage limits and may be rate-limited, changed, or withdrawn at any time. It requires an account and, where indicated, an active Pro subscription.

8. Pro Subscriptions and Billing

Affirm may offer paid monthly or yearly automatically renewing Pro subscriptions.

• Billing, renewal, cancellation, refunds, and payment processing are handled by Apple App Store or Google Play under their own terms and policies.
• RevenueCat may be used to help manage subscription state and entitlements.
• Your subscription renews automatically unless you cancel it through your app store account before the end of the current billing period.
• Prices may vary by platform, country, currency, and promotional offer.
• Except where required by law or by the applicable app store's policy, fees are non-refundable.
• We may change the features included in Pro, as well as pricing or availability, at any time to the extent permitted by law.

9. Acceptable Use

You agree not to:

• use the Service in violation of any applicable law or regulation
• interfere with, disrupt, or compromise the Service or related systems
• attempt to gain unauthorized access to the Service, other accounts, or our systems
• attempt to reverse engineer, decompile, or disassemble the Service except where applicable law expressly permits it
• bypass, disable, or interfere with subscription, security, authentication, or feature-access controls
• use the Service in a way that infringes another person's rights, including privacy, publicity, or intellectual property rights

10. Third-Party Services and Links

The Service may rely on or link to third-party services, including Apple (including Sign in with Apple), Google (including Google Sign-In), RevenueCat, our hosting and storage providers, OpenRouter and the AI model providers it routes to (for the AI affirmation generator), and sharing or external-link destinations you choose to open. We do not control those third-party services, and your use of them may be governed by their separate terms and policies.

11. Intellectual Property

The Service, including its software, branding, design, and preloaded affirmation content, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service to you, other than the limited license expressly granted above.

12. Availability and Changes

We may modify, suspend, or discontinue any part of the Service, including account or cloud backup features, at any time. We do not guarantee that the Service, or any particular feature of it, will always be available, uninterrupted, secure, or error-free.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that backed-up content will be preserved without loss.

14. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, business, or goodwill arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid, if any, for the Service during the 12 months before the event giving rise to the claim.

15. Termination

We may suspend or terminate your access to the Service, or delete your account, if you violate these Terms or if we reasonably believe your use of the Service creates risk, harm, or legal exposure.

You may stop using the Service at any time, and you may delete your account. Termination does not affect any rights or obligations that by their nature should survive termination.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may update the effective date above and publish the revised Terms through the Service, the relevant app store listing, or another appropriate channel. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
